These Terms apply to the rights and obligations related to the purchase of products through the Dermoestetik Online Shop, and the rights and obligations arising from the conclusion of the Distance Sales Agreement (hereinafter: the Agreement) between the consumer as the end customer and the Dermoestetik Online Shop, consider are an integral part of such contracts.

2. ONLINE SHOPPING THROUGH THE “DERMOESTETIK ONLINE SHOP”

CONCLUSION AND TERMINATION OF THE SALE AGREEMENT

These Terms and Conditions as well as individual terms of sale indicated with information about certain products represent an offer by DERMOESTETIK GROUP d.o.o. for the conclusion of the Agreement, and the user as a Buyer by registering, concluding an order or in another way determined by these Terms and Conditions accepts them, which means that the Agreement between the user and the company DERMOESTETIK GROUP d.o.o. is considered to have been concluded, according to the terms of sale specified in these Terms.

By registering in the Dermoestetik Online Shop and/or signing up for the Newsletter, the user gives his consent that the Dermoestetik Online Shop may, for the purpose of promoting services and products, inform him via e-mail about changes or additions to pages, discounts, promotions, products or changes in the way the service is provided. The user can change his mind at any time and unsubscribe from the list of Newsletter recipients.

The purpose of the Agreement is the purchase of the selected product through the Online Shop Dermoestetik with the payment of the corresponding fee (price) of that product and the associated price of the delivery service of the same product. The contract is concluded by means of remote communication (Contract concluded at a distance) through: internet order in Online Shop Dermoestetik, printed promotional messages with purchase order and telephone with human intervention. The user is authorized to choose the option for the Seller to inform him about new products, products on sale, etc. (newsletter). After successful registration (correctly filling in all required information), a notification about successful registration will be sent to the user’s e-mail. The products that can be bought are advertised on the domain www.esensamediterana.com, and with each product there is information about the product specification and price. The price and delivery conditions are listed in the Delivery section.

All product prices on the website www.esensamediterana.com are expressed with VAT included. Before concluding the Agreement, the user has the opportunity to review the Terms and Conditions by clicking on the Purchase Terms section. The contract enters into force and is binding from the moment the user accepts the offer of DERMOESTETIK GROUP d.o.o. in one of the following ways:

– by selecting payment and completing the order as a registered user of Dermoestetik Online Shop,
– by selecting payment and completing the order as a guest user of the Dermoestetik Online Shop,
– by selecting payment and completing/changing the order by phone at +385 52 732 366 from Monday to Friday from 8 a.m. to 4 p.m. (other inquiries should be sent to info@dermoestetik.hr).

In the process of registering or creating a user account, the user is obliged to choose a name or names under which he will provide services and choose a security password and submit a valid e-mail address. All data required for registration or creation of a user account must be true, and the use or use of third-party data is expressly prohibited.

The registration or user account is created only for one person and it is not allowed to communicate information about the registration or user account to third parties. The user is obliged to keep information about his security password and user account. The use of someone else’s registration or user account is not allowed.

For violation of the Terms and Conditions from this chapter, DERMOESTETIK GROUP d.o.o. reserves the right, at its discretion, to terminate the user’s registration or user account, without the obligation to compensate the user for any cost or damage.

The Agreement enters into force when the user accepts the offer to enter into such an Agreement. Product purchase agreement between the Customer and the company DERMOESTETIK GROUP d.o.o. it is concluded at the moment of payment for the product.

On the occasion of the conclusion of the Agreement, the user will be provided with an electronic review and/or an email delivered to the email address containing: a confirmation of the concluded Agreement, i.e. a pre-contractual notice from Article 57, Paragraph 1 of the Consumer Protection Act (Official Gazette, 41/14) , these Conditions, and the notice on the user’s right to unilateral termination of the Agreement with the form for unilateral termination of the Agreement from Article 61, paragraphs 1 and 2 of the Consumer Protection Act.

The User/Buyer may unilaterally terminate the Agreement within 14 (fourteen) days without giving a reason. According to Art. 79, paragraph 1 of the Consumer Protection Act (Official Gazette, 41/14), the user does not have the right to unilaterally terminate the Agreement if the service has been fully fulfilled, and the fulfillment has begun with his express prior consent and with his confirmation that he is aware of the fact that will lose the right to unilaterally terminate the Agreement if the service is fully fulfilled.

In order for the Customer to exercise the right to unilaterally terminate the Agreement, he must notify DERMOESTETIK GROUP d.o.o. about your decision to unilaterally terminate the Agreement before the expiration of the term, by an unequivocal statement sent by post (to DERMOESTETIK GROUP d.o.o., ulica rijeke Dragonje 1, Industrijska zona Vidal, 52466 Novigrad – Cittanova, Croatia) or by email to: info@dermoestetik.hr, in to which he will state his name and surname, address, telephone number or e-mail address, order or invoice number, and he can also use the specified written form for unilateral termination of the Agreement. Also, the Form for unilateral termination of the Agreement, which is available on the website of the Online Shop Dermoestetik in the section Conditions of Sale, can be electronically filled out and sent by the Buyer, in which case DERMOESTETIK GROUP d.o.o. send confirmation of receipt of notice of unilateral termination of the Agreement by electronic mail without delay. The deadline for unilateral termination of the Agreement is 14 (fourteen) days from the day when the goods that are the subject of the Agreement were handed over to the Buyer or a third party designated by the Buyer, who is not the carrier, or, in the case of services, from the conclusion of the Agreement.

If the user unilaterally terminates the Agreement, he will be refunded the money received from him, including delivery costs, without delay, and no later than within 14 (fourteen) days from the day when DERMOESTETIK GROUP d.o.o., i.e. Online Shop Dermoestetik receives the user’s decision on unilateral termination of the Agreement. The refund will be made in the same way the user made the payment. In the event that the user agrees to another way of returning the paid amount, he does not bear any costs in relation to the return. Refund DERMOESTETIK GROUP d.o.o. can execute only after the goods have been returned to him.
The buyer is obliged to hand over the goods or send them to the address of DERMOESTETIK GROUP d.o.o. (for Dermoestetik Online Shop), 1 Rijeka Dragonja Street, Vidal Industrial Zone, 52466 Novigrad – Cittanova, Croatia, without undue delay, and in any case no later than 14 (fourteen) days from the day on which DERMOESTETIK GROUP d.o.o. that is, to Online Shop Dermoestetik, sent its decision on unilateral termination of the Agreement. According to the Consumer Protection Act (Official Gazette 41/14, Article 77), the buyer must bear the costs of returning the goods independently. The customer is responsible for any decrease in the value of the goods resulting from the handling of the goods.

If, at the Customer’s request, the execution of the service began during the period for unilateral termination of the Agreement, the Customer is obliged to pay the company DERMOESTETIK GROUP d.o.o. an amount that is proportional to what was delivered by the time the Customer notified DERMOESTETIK GROUP d.o.o. on unilateral termination of the Agreement. You can electronically fill out and send a copy of the form for unilateral termination of the contract, which is available on our website.

FORM FOR UNILATERAL TERMINATION OF THE AGREEMENT ON THE PURCHASE OF PRODUCTS AND SERVICES

TERMS OF THE PURCHASE PROCESS

Basic product characteristics, prices, special promotions and benefits, payment and delivery methods refer to those valid at the time the order is placed. The above data will be indicated with each product. The price of the product, which includes the amount of VAT and the cost of delivery, is visible in the shopping cart before the order is placed. The cost of delivery may also be visible on some other parts of the page. All information about the purchase confirmation based on the electronic order will be delivered to the customer’s e-mail address specified in the registration/order process or in the shopping cart when entering data when concluding the order. All prices are expressed in Croatian kuna (HRK). All prices of products and services offered on www.esensamediterana.com include VAT.

DERMOESTETIK GROUP d.o.o. treats the selected products in the basket of a registered or unregistered user as an order, and reserves the right to cancel it for a justified reason. In case of cancellation of the order, the Dermoestetik Online Shop staff will notify the user of the aforementioned via his e-mail address or registered contact phone number, along with the reason.
If the Customer does not receive the order confirmation notification, there is a possibility that he entered his e-mail address incorrectly. In this case, the customer can contact Online Shop Dermoestetik at: info@dermoestetik.hr or at phone number +385 52 732 366 from Monday to Friday from 8 a.m. to 4 p.m., so that the employees can check whether the order has been received.

At the time of ordering an individual product from the offer, the user/Buyer (in the sense of the Consumer Protection Act) by agreeing to the Terms of Purchase confirms that before concluding the contract he has taken note of the information published on the domain www.esensamediterana.com and its subpages, i.e.: name, company or the name, registration number and registered office of the Merchant in the ways in which he can express his objections; information on the products offered, as well as their name, main features and the price of the product, including all taxes and other duties; information about product delivery costs; as well as information on the method of payment, and the method and term of delivery of the product.

Online Shop Dermoestetik (DERMOESTETIK GROUP d.o.o.) is obliged to deliver to the user/Buyer (in the sense of the provisions of the Consumer Protection Act) a confirmation of the aforementioned content in writing or another available permanent medium, as soon as possible, and at the latest at the time of product delivery. By agreeing to these Terms and Conditions, the user/Buyer agrees that the confirmation of the prior notice will be sent to him by electronic mail to the e-mail address he indicates as a contact when entering his order.

METHOD OF PAYMENT

Product prices are displayed next to the product itself and are valid for all forms of payment. All prices include VAT.

The customer can make the payment in the following ways:

– in cash at the shop upon personal collection at Ulica rijeke Dragonje 1, 52466 Novigrad
– cash on delivery via the GLS courier service only for orders within the territory of the Republic of Croatia.
– by general money order or direct debit, after receiving the order, and during working hours, we send you an offer to your e-mail address on the basis of which you will pay at any bank, post office, FINA or internet banking.
– Credit or debit card payment

If a customer from outside the Republic of Croatia pays with a credit or debit card through our online store, the system will automatically charge 5 euro for postage, in which case we will send you a link for additional payment after we calculate the amount of postage for your country.

If the customer chooses the option of personal collection at Dermoestetik shop instead of delivery, no delivery fee is charged. The deadline for picking up the ordered product is up to 10 working days.

PRICE AND DELIVERY TERMS

The shipping price is indicated on each completed order. The price of delivery is not included in the price of the product. Purchased products can be delivered in the territory of the Republic of Croatia, as well as abroad, according to the conditions that apply to each delivery area.

The costs of delivery of products ordered in the Esensa Mediterana Online Shop in the Republic of Croatia are as follows:

• orders up to €55 are paid at a rate of €5.98
• orders over €55 have FREE DELIVERY (valid only for the territory of the Republic of Croatia)

All products are delivered via the courier service GLS link: https://gls-group.eu/HR/hr/home. Order processing takes up to 4 days, and the delivery time is up to 10 working days from the date of payment.

The delivery date also includes the day of processing the order, the time required for the completion and packaging of the product, and the delivery of the package by the delivery service. For shipments addressed to islands and smaller places, the deadline for delivery may be extended due to a special timetable.

For a large quantity of ordered products, the delivery time is up to 4 weeks, which includes delivery abroad.

International shipping is charged according to the GLS price list available here.

The products will be stacked and packed in such a way that they cannot be damaged by normal handling during transport.

Product packaging is included in the delivery price. Delivery is performed according to the terms of use of the delivery service, and is considered completed at the moment of handing over the product to the delivery service. If the product sent to the Customer or Recipient is returned to Dermoestetik Group d.o.o. because the delivery service failed to make the delivery, the Customer will be notified by e-mail and will be offered the following options:

That the ordered product be re-delivered to the Buyer’s or Recipient’s address at the Customer’s request, or that the ordered product be picked up at Dermoestetik’s address, Ul.rijeke Dragonje 1, 52466 Novigrad, Croatia, with payment for transport and return to Dermoestetik Group d.o.o. at a price of 10 euro, and additionally for another transport if the Customer wants to receive the product via courier service.

REPLACEMENTS, COMPLAINTS AND OBJECTIONS, AND MATERIAL LIABILITY

The customer has the right to a justified complaint and to return the goods in the event of:

• Delivery of goods that were not ordered
• Delivered goods that are damaged or incomplete, and this was not taken into account, due to our inadvertent oversight, when forming the sales price

The deadline for submitting a complaint is 8 days from the receipt of the package.
In the case of a request for the return of goods for justified reasons, the buyer is obliged to send a written complaint to Dermoestetik group by e-mail to info@dermoestetik.hr or by registered mail to the address: Dermoestetik Group d.o.o., ul.rijeke Dragonje 1, 52466 Novigrad, Croatia.

In order to determine as quickly as possible the specific order to which the customer has an objection, customers are asked to state the order number or invoice number in the objection. The dermoesthetician will confirm the receipt of the complaint in writing without delay, and the answer according to Article 10.para.5. of the Law on Consumer Protection must arrive within 15 (fifteen) days from the day the complaint was received.
In the event of a justified complaint, the customer has the right to terminate the contract with a refund of the amount paid or a replacement for an undamaged and valid product, which was not caused by handling during transport for which GLS is responsible.

In order for the Customer to be able to exercise the right to unilaterally terminate the Agreement, he must inform Dermoestetik of his decision to unilaterally terminate the Agreement before the expiration of the term, by an unequivocal statement sent by mail to the above-mentioned address or by e-mail, in which he will state his name and surname, address, telephone number or e-mail address, order or invoice number, and can also use the specified written form for unilateral termination of the Purchase Agreement. 3. PROTECTION OF USER/BUYER DATA

Online Shop Dermoestetik undertakes to respect the anonymity and privacy of users of Online Shop Dermoestetik, and will use and process this data exclusively for the purpose and purpose specified in these Terms. Online Shop Dermoestetik can collect personal data of the user, such as name, address, OIB, telephone number or e-mail address only if the user voluntarily submits them to Online Shop Dermoestetik.
